Bite Size Jewelry Design Submission Legal Terms & Conditions

By sending your artwork to Bite Size Jewelry and in consideration of Bite Size Jewelry evaluating your Design (hereinafter the “Design”) for its possible use on pendants and other jewelry (the “Jewelry”), you agree to the following terms and conditions (“Design Submission Terms and Conditions”):

If your Design is selected, Bite Size Jewelry may use your Design in any manner on or in connection with the Jewelry, including but not limited to: reproducing the Design on the Jewelry, selling Jewelry bearing the Design, changing or reworking the Design by making color or size changes, making derivative works of the Design, using the Design on the BiteSizeJewelry.com website and on promotional material for Bite Size Jewelry.

However, if you want adjustments to your Design to be limited only to size changes and cropping then you must state that you want “no derivative works” in your submission.

This license is NON-exclusive, meaning that you maintain ALL rights to your work.

You acknowledge that the Design you are licensing to Bite Size Jewelry is your own original work, has not been previously licensed for use on Jewelry in a way that will conflict with this agreement, and does not contain any trademarks, logos, copyrighted material, or any other intellectual property belonging to any third party, or any material, which Bite Size Jewelry in its sole discretion, deems to be profane or offensive.

You acknowledge that Bite Size Jewelry reserves the right to decline to select a Design for consideration for any reason, including poor design, as further explained in the “Decline Reasons” page of our blog site.

If your Design is selected for use by Bite Size Jewelry, you will receive: $1.00 for every Jewelry item containing your Design sold at retail price, and $0.50 for every Jewelry item containing your design sold at wholesale price. Royalties will be paid at the beginning of each month via PayPal when total earnings exceed $20. If total earnings remain below the limit stated above, then Bite Size Jewelry shall retain said earnings until they exceed the limit. Bite Size Jewelry reserves the right to change these payment terms at any time, by posting them on the BiteSizeJewelry.com website or BiteSizeJewelry.wordpress.com blog, and changes will be effective upon posting. Payment will be based on the terms in effect when your Design is submitted for consideration. You alone will be responsible for the payment of any tax that arises as a result of receiving payment from Bite Size Jewelry.

Participants, who in the opinion of Bite Size Jewelry, do not comply with these Design Submission Legal Terms and Conditions, or for any other reason at Bite Size Jewelry”s sole discretion, can at any time be excluded from consideration without notice.

You may cancel this agreement at any time, by emailing Bite Size Jewelry at art@bitesizejewelry.com. Once notified, Bite Size Jewelry will have 6 months to sell the remaining inventory containing your Design.

The decisions of Bite Size Jewelry are final and binding.
